Agreement

By accessing or using Divergencecore (“the Platform”), you agree to these Terms of Service. The Platform is operated by Lucid Tech LLC (“we,” “us,” “our”). If you’re using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.

The Platform

Divergencecore provides Adaptive Compound Intelligence tools for team collaboration, including live compound sessions, cognitive profiling, org memory, and related features. We reserve the right to modify, suspend, or discontinue any part of the Platform with reasonable notice.

Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access.
  • One organization account per entity. Team members are added under the org account.

Your Data

You own your data. Specifically:

  • All session content, org memory, cognitive profiles, and team data belong to your organization.
  • We do not claim any ownership or intellectual property rights over your data.
  • You can export or delete all your data at any time.
  • We do not use your data to train AI models or share it with third parties.

Acceptable Use

You agree not to:

  • Use the Platform for any illegal purpose or in violation of applicable laws.
  • Attempt to access other organizations’ data or bypass permission controls.
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform.
  • Use the Platform to develop competing products.
  • Exceed reasonable usage limits or abuse API access.
  • Upload malicious content or attempt to compromise Platform security.

Subscriptions & Billing

  • Paid plans are billed monthly or annually as selected.
  • Free trials do not require a credit card.
  • You can cancel at any time. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support.
  • We may change pricing with 30 days notice. Existing subscribers keep their rate until the end of their current term.

BYOK (Bring Your Own Key)

If you use the BYOK option, you maintain a direct relationship with your AI provider. We are not responsible for charges, outages, or policy changes from your provider. Your API key is stored encrypted and used solely to process your team’s requests.

Intellectual Property

The Platform, its design, code, and underlying technology (including the ACI framework, Patent Pending #63/987,765) are the intellectual property of Lucid Tech LLC. Your subscription grants you a license to use the Platform — not ownership of it.

Limitation of Liability

To the maximum extent permitted by law, Lucid Tech LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from these terms or the Platform is limited to the amount you paid us in the 12 months preceding the claim.

Termination

Either party may terminate at any time. Upon termination, you have 30 days to export your data before it is permanently deleted. We may terminate your account immediately for violations of these terms, with written notice explaining the reason.

Governing Law

These terms are governed by the laws of the State of Colorado, United States. Any disputes will be resolved in the courts of Denver, Colorado.

Changes

We may update these terms with 30 days notice. Continued use after changes take effect constitutes acceptance. Material changes will be communicated via email.
